The UAE Introduces New Media Sector Legislation

On 18th December, 2023, the UAE government introduced an extensive federal decree law designed to govern media activities within the country. This strategic initiative aims to instill order in the Emirates' media sector, enhance its standing as a global media hub, and foster an environment conducive to industry growth.

The newly established regulations, applicable to individuals, organizations, media outlets, and media-focused free zones across the nation, will afford opportunities for individuals and legal entities to own media institutions and outlets under specific regulations and conditions.

Encompassing a broad spectrum of activities, including the production, circulation, printing, and publishing of media content, as well as audio, video, and digital broadcasting, the decree outlines provisions for issuing and supervising licenses and permits for various media endeavors.

Emphasizing the pivotal role of the UAE Media Council and local government entities, the decree outlines their responsibilities in overseeing media regulations.

As per the decree, all media individuals and institutions are required to "adhere to national standards," which include respecting religious beliefs, safeguarding the country's sovereignty and symbols, complying with national policies, and refraining from "actions that could harm national unity or social harmony."

According to the decree, the issuance of permits for the screening of cinematographic and creative productions falls under the purview of the UAE Media Council.

Beyond outlining the classifications of the Media Content Rating System for various creative works, including books, video games, and cinematic production, the council is tasked with determining age-appropriate audiences for media and entertainment content.

Furthermore, the council is responsible for granting permits to individuals engaged in advertising or creating media content on social media and other modern technical platforms, whether at a cost or free of charge.

To uphold ethical standards, the decree mandates that licensed individuals and media outlets are subject to oversight and supervision by the competent authority.

Collaborating with relevant authorities, the UAE Media Council will actively promote the protection of intellectual property for individuals, establishments, and other media institutions in the country.

Individuals, organizations, and media outlets are granted a 12-month period, extendable by Cabinet decision, to comply with the new regulations from the effective date, underscoring the government's commitment to ensuring a seamless transition for stakeholders to align with the updated regulatory framework.
